網員服務條款

1、"佳士德藝術品拍賣有限公司”網員服務的運作權和解釋權，全歸”佳士德藝術品拍賣有限公司”(以下稱為 “佳士德藝術網”www.chritrs.com/com.cn/ com.hk). “佳士德藝術品網”的用戶必須安全地使用服務、並嚴格遵守本服務條款。在遵守條款的情況下，用戶可使用佳士德藝術品網提供的免費服務。

2 “佳士德藝術品網”員服務系統，要求用戶同意以下：
(一)提供及時、詳盡及準確的個人資料。所有原始鍵入的資料將被引用為註冊資料。
(二)用戶的註冊信息發生變化後，用戶必須及時更新自己的註冊信息。所有用戶輸入的註冊信息，將被視為能有效地準確表示用戶身份的信息，並將作為我們 “佳士德藝術品網”舉行有關活動，及進行客戶認可的有效用戶身份信息。如果用戶提供的個人資料錯誤、不實、過時或不完整，我們保留結束用戶使用 “佳士德藝術品網”網員服務的權利。在此情況下，如用戶需要幫助 “佳士德藝術品網”亦可能因不能確認用戶身份及其帳號，而導致不能為用戶作出相應的幫助，用戶須自己承擔因提供錯誤個人資料所帶來的不便及後果。
(三)接受 “佳士德藝術品網”不定時向您發送的信息，如果用戶提供的資料不准確 “佳士德藝術品網”有權修改及刪除任何虛假、違法、有損他人名譽和利益、侵權的一切信息，並有權結束用戶使用佳士德藝術品網,網員服務。用戶必須同意此條款及接受 “佳士德藝術品網”不時地對此條款所作的有關任何修改。

3、服務條款的修訂 “佳士德藝術品網”有權在必要時修改服務條款. “佳士德藝術品網”服務條款如被修改，佳士德藝術品網將在其重要頁面上提示用戶修改過的部份。如用戶不同意修改後的服條條款，可以隨時終止接受佳士德藝術品網提供的服務。如用戶繼續使用 “佳士德藝術品網”提供的服務，則將被視為已接受服務條款的變更。

4、網員的帳號，密碼及其安全性 用戶成為網員後，將得到一個 “佳士德藝術品網”帳號和密碼。網員對帳號和密碼安全性負上全部責任. “佳士德藝術品網”不承擔網員的帳號、其密碼的安全、保密責任以及因網員的帳號和密碼的洩露，所導致的一切損失。網員將因等級不同，享有不同的權限。另外，每個網員都須為其帳號的行動和事件負全部責任。網員可隨時改變自己的密碼，亦可以結束舊帳戶再重開一個新帳戶。網員若發現有任何人仕非法使用自己的帳號或網頁存在其他安全漏洞的問題，可立即通知 “佳士德藝術品網”有関部門。

5、服務擔保 針對用戶發布的信息，收費網員及最新發布的信息排序靠前；同為“佳士德藝術品網”,網員，則按網員級別及時間排序。用戶須承擔使用 “佳士德藝術品網”,網員服務的一切風險，這並不單單限於財務和投資風險。對此 “佳士德藝術品網”不作任何擔保，不論是明確的或不明確的擔保, “佳士德藝術品網”不保證服務一定能滿足用戶的要求。用戶須明確了解，並同意因以下原因而造成之損失，包括但不限於利潤、商譽、使用、資料損失或其他無形損失, “佳士德藝術品網”不承擔任何直接、間接、附帶、特別、衍生性或懲罰性賠償，本服務無法使用，包括但不限於服務中斷、對於服務的及時性、安全性、出錯或丟失；經本服務購買之任何商品、資料或接受的服務，或接收之訊息；用戶的資料或資料的傳輸遭到不獲授權的存取或變更；用戶對於產品資料的維護和更本服務其他相關事宜。

6、用戶管理 用戶須為其在佳士德網員服務內發佈內容負責任。用戶使用 “佳士德藝術品網”網員服務時，是根據所有適用於 “佳士德藝術品網”網員服務的國際法律標準、國家法律和地方法律的。用戶必須遵循以下數點：
（一）發布的資料必須符合有關香港本地的法律、法規、條例及佳士德藝術品拍賣有限公司（以下簡稱“本公司”）的章程，並參照國際通行有關慣例制定，及法律法規。
（二）不以 “佳士德藝術品網”網員服務作任何非法用途。
（三）不干擾, “佳士德藝術品網”網員服務網絡服務。
（四）遵守所有 “佳士德藝術品網”,網員服務的有關網絡協議、規定和程序。 包括：用戶須承諾不傳輸或發布任何包含非法、具騷擾性、中傷他人、辱罵、恐嚇、傷害別人、庸俗，淫穢內容的信息資料。另外，用戶也不能傳輸或發布，任何教唆他人構成犯罪行為的資料；不能傳輸、發布對國家不利以及對國家安全構成威脅的資料；不能傳輸、發布任何違反國際法律、國家法律和當地法規的資料。在未經許可的情況下，用戶不得非法進入其它電腦系統。若用戶違反以上提及的服務條款，佳士德藝術品網將判斷是否立即取消該該用戶之服務帳號. “佳士德藝術品網”無須為任何用戶發布的內容負責，包括任何內容、任何錯誤或因遺漏而衍生之任何損失或損害。

9、結束服務 用戶或 “佳士德藝術品網”可隨時根據實際情況，中斷 “佳士德藝術品網”網員的服務.無須因中斷服務而對任何個人或第三者負責。用戶若反對任何服務條款、對條款修改有異議，或對 “佳士德藝術品網”的服務不滿，用戶有以下權利：
（一）不再使用 “佳士德藝術品網”網員服務。
（二）通告 “佳士德藝術品網”停止該用戶的服務。 用戶服務停止後，用戶使用 “佳士德藝術品網”網員服務的權利將馬上終止。此後，用戶將不再享有在 “佳士德藝術品網”網員服務用戶的任何權利， “佳士德藝術品網”也沒有義務傳送或發出信件給該用戶或第三者。

10、通告 所有由 “佳士德藝術品網”發給用戶的通告都可通過電子郵件或常規的信件傳送。服務條款的修改、服務的變更、或其它重要事情都會以此形式進行傳送。所有修改的條款構成本服務條款的一部分。

11、免責聲明 所有的物品將有適當的介紹，競價者應仔細瀏覽競價商品的介紹，並表明您對競價的物品已有充分的了解, “佳士德藝術品網”不對該物品的瑕疵和實質情況承擔任何責任，一切因競價活動而產生的糾紛與佳士德藝術品網無關。每場競價活動及，所有的物品的最終解釋權歸於競價活動發起人，發起人保留更改物品數量、競價活動結束時間等權利。本網站只為會員提供一個競價空間，對於每場競價活動並不持有最終解釋權。

12、用戶同意保障和維護全體成員在 “佳士德藝術品網”的利益，超出服務範圍引起的律師費用、因違反服務條款而造成損害的補償費用、用戶的電腦被其他人使用、帳號以及其它知識產權的追索費一切由用戶支付。

13、 數據庫中用戶信息內容的所有權 “佳士德藝術品網”網員服務數據庫的用戶信息內容包括：文字、軟件、聲音、相片、錄像、圖表、廣告內容、電子郵件內容；所有內容的受版權、商標、標籤和其它財產所有權受法律保護。因此，這些內容必須在本公司授權下才能使用，不能擅自複制、再造、或創造任何與該內容有關的派生產品。

14、本網站不承擔電郵在發送過程中，無法預知的延期，或因用戶自身原因所導致的競價失敗。對於無法發送電郵的技術問題及因系統導致的一切問題，本網站一概不負責。

15、法律解釋 本規則根據香港本地有關法律、法規、條例及 “佳士德藝術品拍賣有限公司”章程訂立，並參照國際通行有關慣例制定。

Conditions for the Users (網員服務條款)
1. Chritrs Arts Auction Limited (also as www.chritrs.com/com.cn/com.hk below) reserves the right of operation and interpretation of the website. All users of www.chritrs.com/com.cn/com.hk must safely use the services of the website, and strictly observe the user’s conditions. Users may enjoy the service provided on-line freely if they follow the terms.
2. www.chritrs.com /com.cn/com.hk required users to recognize following terms:
- To provide us with your detailed and precise personal information that will be used as information for membership registration. to update your register information when you realize there are changes. All the information provided by the users will be treated as precise reference of the user’s identity. “Chritrs arts”would have to confirm the user’s identity based on the information they provided in some events, there fore, “Chritrs arts” reserved the right to cease user’s access to the website if the user provided “Chritrs arts” with wrong, untrue, untimely and incomplete information. Under this circumstance, “Chritrs arts” might not be able to give relevant support to the user when it failed to confirm the identity of the user because of the incorrect input of information committed by the user. User have to bare all the inconvenience and consequence caused for providing incorrect information.to receive occasional messages from “Chritrs,arts”if incorrect information is provided, “Chritrs arts” have the right to amend or delete any information which is false, illegal, harmful to others reputation and interest, violating the copyright. In this conditions, “Chritrs arts” also have right to cease user’s access to the website. User must agreed with the conditions stated here and accept occasional amendment make by “Chritrs.arts”
3. Amendment of conditions
“Chritrs arts”possesses the right to amend its service conditions. “Chritrs arts”will inform the users about the amended condition in its website. If user disagreed with the amended terms, he/she could cease to receive the services from “Chritrs arts”at anytime. Users are supposed to agreed with the changed terms if they continue to use the services provided by “Chritrs.arts”
4. Login name, password and safety issue
A login name and password will be given to user, once he/she is admitted to be a member of the website. Members are responsible for the security of their login name and password. “Chritrs arts” is not responsible for the security of member’s login name and password, and all the loss caused due to disclosure of these information. Members enjoy different rights according to their level. In addition, members bare all the responsibility for the action taken in their name. Members may change their passwords anytime, and may close their account and start a new one. Please contact “Chritrs,arts”if you discover unauthorized use of your account or any safety loophole.

5. Guarantee for services
Messages from the charged members and latest announcements will occupy the front position; ordinary “Chritrs arts” members will be put in order according to level and time. Users have to bare all the risk that might caused for using the services on the website, not only confined to financial and investment loss. “Chritrs arts”does not make any direct or indirect guarantee. Also, “Chritrs arts”does not guarantee its service will meet all clients’ demand. Users must acknowledge and agreed that “Chritrs arts” will not have any responsibility for profit, commercial, reputation, information, other visible or invisible loss that might caused to them. And “Chritrs arts” will not have to make any direct, indirect, additional, special, punitive compensation for user’s loss. “Chritrs arts”is not responsible for following: cease of service, the consistency of online services, the security of the purchased item or other information, mistakes make in services or messages, unauthorized utilization of user’s information by other parties.
6 User management
Users are responsible for the information they published on www.chritrs.com/com.cn/
com.hk. Users have to strictly follow the international law, country law and regional law which are applicable to www.chritrs.com/com.cn/com.hk. They have to follow the terms stated below:
(a) Published information must follow the Hong Kong law, regulation and ordinance and the conditions of “Chritrs Arts”Auction Limited, also to observe the practice of international regulations.
(b) Not to use the website to attempt illegal practice
(c) Not to disturb the network of www.chritrs.com/com.cn/com.hk
(d) Observe all the agreement, terms and procedure of www.chritrs.com/com.cn/com.hk including: not to submit any illegal message, disturbing, humiliating, intimidating message, message with rude and pornographic content. Apart from that, users are not allowed to publish or submit message that instigate others to commit crime, or message that intimidate national security; message that violate the international , national, local law are strictly forbidden. Users must not enter other computer network without permission. When users violate any of the conditions mentioned above, “Chritrs arts” will decide whether to cease the account of the user. “Chritrs arts”do not have any responsibility over the messages published by any user, including any potential loss and harm that would cause to the user.
6. Cease of services
Both users and “Chritrs arts” may cut the services provided by www.chritrs.com. /com.cn/com.hk “Chritrs arts” has not responsibility for cease of service. If user discontent with the amendment of conditions or “Chritrs,art” they possess the right to:
(a) cease to use the services provided by www.chritrs.com/com.cn/com.hk
(b) inform “Chritrs arts” to cease their account, and the right they enjoyed in “Chritrs arts”s website will also halt, and “Chritrs arts”does not the obligation to send mail to the user or other party.
7. Notice
“Chritrs arts” will distribute notice to the users either through e-mail or regular postal services. Amendment of service conditions, transformation of services or other important notification will normally send to the users through the above mentioned method. All the amended conditions formed part of the service conditions.

9. Disclaimer of warranties
Appropriate description will be given to all the items. Bidder should patiently browse through introductions of lots, and show good understanding to the lot that you are going to bid for. “Chritrs arts” is not responsible for the flaw and actual condition of the lot.“Chritrs arts” will not be responsible for arguments that originated from all bidding activities. The initiator of bid reserved the ultimate right of interpretation for all the lots. Initiator reserved the right to change the quantity of lot, end time of the auction. The website provides only a bidding place for members and does not possess interpretation right for bids.

10. To secure the right of member in “Chritrs,arts”the fee stated below will be paid by users: legal fee charged out of the service range, penalties due to violation of service conditions, charges related to unauthorized access to account, copyright.

11. User information data bank
Information in the data bank of “Chritrs arts” included: word, software, sound, photograph, video, diagram, advertisement, content of e-mail. The content of copyright, trademark, label and other property are all under the protection of law. Therefore, content of these items must not be used without the permission of “Chritrs arts” no one is allowed to photocopy, remake, or create anything related to the content of these items.

12. This website is not responsible for unpredictable delay in e-mail submission, or bid failure for the user’s cause. This website is not responsible for technological problems caused by e-mail network or telecommunication system.

13. Legal interpretation
Regulation stated here based on Hong Kong law, regulation, ordinance and the conditions constituted by Chritrs Arts Auction Limited, and refer to the international legal practice.
